SALES AND DELIVERY TERMS
The following terms apply for the purchase of products and services from the mono.net website and the use of the website in general.

Note that the following terms of use also apply when signing up for a trial subscription (mono free).

This agreement is entered into between you and Reload ApS.

You must be 18 years of age, when acquiring an account and consenting to this agreement. By accepting this agreement you are consenting that the current terms and conditions will apply to the relationship between you and mono.net.

Delivery, billing and signing up to payment service
Once you have completed your purchase you can log in to your mono website with your username and password. You will receive an electronic invoice by email (electronic billing).

NOTE! When paying with a credit card, you are automatically enlisted to mono.net’s direct debit service. This means, that your subscription will automatically be renewed via your credit card directly after the expiration date for the cancellation of the subscription. In this way it is prevented that your website ceases to exist. The subscriber is responsible for updating his email address in My Account.

Duration and cancellation
A subscription runs for 12 months and can at all times be cancelled with minimum of 45 days notice before expiration of the subscription period. For example, if you have started a subscription on January 1st 2010, it will run until December 31st 2010. If a subscriber wishes to discontinue his subscription after this date, he will have to cancel it at the latest November 15th 2010. Any prepaid subscription left in the period will not be refunded. If you have choosen to pay for more than 12 months at a time your subscription period will follow your payment rate. It is not possible to change the payment frequency of your subscription.

The subscriber must pay his subscription in advance. It is only possible to pay with credit cards. The following credit cards are accepted: MasterCard, VISA, American Express and Dankort.

If a subscription payment is not completed, for any reason, the subscriber will receive an e-mail asking him to change his credit card information. In a case where the subscriber does not change his credit card information within 30 days of the initial notice, the mono account in question will be closed without further notice.

mono.net can at any time discontinue a subscription with 30 days notice, if the subscription type in question is subject to discontinuation. In such a case the subscriber will be refunded any difference for the subscription in question.

Moreover, mono.net can, acting upon own discretion and without further reason, discontinue any given subscription with a 30 day written notice to the e-mail address affiliated with the subscription in question. In such a case, all differences from the advance payment for the subscription will be refunded.

Newsletter
By accepting the terms and conditions in this user agreement, the subscriber also agrees to be enlisted on Reloads mailing list. The subscriber can at any point choose to deregister by clicking the unsubscribe link contained in the newsletter.

Services and prices
mono is an online application (website builder) available via mono.net.
Prices and features for the products in question are marked along with the product descriptions. All prices are specified everything included Danish VAT.

Changes in subscription
Any subscription can at any time be upgraded to a higher-cost subscription type. In such a case the subscriber will receive a regulating billing proportional with the differences in payment from the given subscription being upgraded from. Also, when upgrading, your subscription will receive a new start-date starting from the day you upgraded. For example, a subscription confirmed on January 1st 2010 and upgraded on March 4th 2010 will hereafter be considered having been started on March 4th and running for 12 months till March 3rd 2011.
It is not possible to downgrade a mono account, but you can always create a new free account.

Domain
In connection with the purchase of a mono subscription is possible to buy one or more domains, attached to a specific mono website.

It is not possible to cancel an order for a domain, since domains are unique. This also applies to wrongly registered domains, such as spelling and typing errors.

By domain order you declare, as the registrant of the domain that you agree that the domain name does not infringe any third party names or trademark rights or otherwise likely to be against the law.

The domain name is registered in the customer's name. mono.net is in the context the service provider and has no liability in connection with registration of the domain. mono.net may in no case be liable for any errors with the creation/transfer of the domain name. The customer is obliged to check whether the creation or transfer of the domain has occurred and must contact mono.net if it is not.

If an own domain is purchased it can take up to five business days and sometimes longer time from the order is delivered and the domain is finally registered. Reservations are made for domains reported as being availabe and thus detectable, and not necessarily the case, since information from the respective TLD administrators at times may appear incomplete.

DK domains
DK domains are registered by DK Hostmaster and you are obliged to abide by DK Hostmaster at all times applicable conditions concerning domains, including DIFO rules for the administration of domain names.

.SE domains
mono.net is an authorized reseller of Swedish domains. Along with .SE will mono work for the positive development of Internet in Sweden for the benefit of users and society as a whole. Our common goal is satisfied domain owners irrespective of whether they are businesses or individuals. When purchasing one .se the domain you agree to the .SE conditions for the purchase of Swedish domains.

Reliability
mono.net reserves the right without notice to limit or restrict access to a mono account or the services as part of a subscription to the extent mono.net deems such restriction necessary for operating and/or safety concern.

PRIVACY
By creating your mono account your personal data is registered and retained by mono.net, including username, email address, name, address, and any other information you have submitted in connection with the creation of your account, such as org. no. and phone number.
mono.net does not store your credit card information.

Privacy
mono.net meets users' needs for privacy. Therefore we cherish the information we receive when you sign up with our service.

Like most other web-based services mono.net collects non-personal information about the operation of mono.net, accessible through the use of servers and web browsers. This information is typically language, browser type, preferences, referring sites and time and date records on every login on mono.net.

The reason for the gathering of this information is to find out how we in the future best serve customers at mono.net based on users preferred preferences. Data collected in this way may, from time to time be published in reports dealing mono.net 's user trends and trends in relation to their daily use of the website.

mono.net also collects some information that could potentially be of personal nature. Such information might include Internet Protocol (IP) addresses. Collected data of this type are not used to identify mono users, and will under no circumstances be given to third parties unless the following conditions are true.

The saving of personally identifiable information
mono.net discloses personally identifiable information only to those of their employees and subcontractors who either: 1) should use this information to process a case on behalf of mono.net or to deliver a service at mono.net 's websites, or 2) have agreed not to disclose information. By using mono.net’s services, you have given your consent to your information may be disclosed to them. mono.net reserves the right to share all collected information with its parent, affiliates and other related businesses. Besides the above exceptions, mono.net will only disclose potentially personally identifiable information and direct personally identifiable information when required by law or if mono.net in good faith believes that disclosure is necessary to protect mono.net 's - third party - or public property and rights.

mono.net reserves the right to publish or otherwise disclose user mono sites. This is also the case with received queries from users (eg. through support function or via the various feedback mechanisms), either to clarify or answer a given query, or to guide and inspire other users.

mono.net take all possible measures to protect potentially personally identifiable information. This includes measures against unauthorized use, modification and destruction of information.

Cookies
mono.net uses cookies to identify and map out users' habits, their preferred setup of the browser as well as their use of mono.net. If you use mono.net but still do not want cookies installed on your computer, you must configure your browser to refuse cookies before you enter the mono website. As a consequence it may possibly have the disadvantage that individual features of mono.net not available or work differently than intended.

Delinquency
mono.net is entitled to terminate the contract in whole or in part in case you significantly breach the terms. Breaching the terms meaning any breach of the obligations of you under this Agreement.

If mono.net can not give notice to you or to renew your subscription, as a result of your failure to update the contact and/or credit card information can mono.net without notice stop providing additional services under this Agreement.

Responsibility
mono.net disclaims all responsibility regarding any losses or damages the subscriber may suffer in relation to his mono subscription. This includes use of or the lack of possible use of the subscribers mono website, with no regards to the circumstances surrounding a given incident except instances where mono.net has purposely or deliberately acted in a harmful or highly negligent manner.

It is sought an uptime of 100%, but mono.net assumes no responsibility for it. It is taken into account that of maintaining and updating the server and client downtime can occur.

mono.net, therefore, disclaims all responsibilities regarding direct or indirect losses, including consequential losses, secondary damage, and collateral damage in relation to any data-loss and subsequent restoring data.

If, by any unlikely string of events, mono.net would be held responsible for the subscribers use of mono, this responsibility will be limited to the equivalent of the payment for the subscriptions duration. It is underlined that a purchased mono online service exclusively is to be used for youself and may not be lent (the disclosure of password), resold or redistributed in any way.

Conveyance of a subscription
mono.net holds the right to transfer any given subscription including any rights, privileges, or obligations, mentioned in this agreement, to a third party.

Changes in terms and conditions
mono.net holds the right to change the contents of this agreement without notice. mono.net moreover reserves the right to adjust prices on the different products at any time. All price adjustments will only affect the prolonging of a subscription, granting the subscriber the chance to discontinue his subscription before price adjustments are enforced. mono also reserves the right to charge for services and/or products previously offered for free. The subscriber is responsible for monitoring the development of subscription fees available at mono.net as well as the terms regarding Swedish and international domains .SE's terms and conditions for registering Swedish domains and

Law
Any dispute which may arise out of this agreement shall be settled according to Danish law.


PLEASE READ THE FOLLOWING TERMS OF USE

The subscriber is obliged to state correct, sufficient, and satisfactory information when creating his mono website using www.mono.net. You agree in this regard to receive legally binding notices via the reported address. It is your responsibility to continuously update your contact and card details so that mono.net at any time to contact you to renew your subscription. Failure to update your information regarded as a material breach on your part.

mono provides a number of design templates for the subscriber. These designs are at the subscriber's disposal on a non-exclusive basis. mono.net retains all rights for the web designs in question, also in the case of user-generated content within mono. Hence, the subscriber has no right to distribute or copy the design templates. If mono.net is compelled to change or remove any of the design templates, mono.net cannot be held responsible for any losses on the subscribers' accounts.

All mono sites are per default tagged with a mono tag linking to www.mono.net.

It is not allowed to use illegal content on mono. This includes content, which is used without the proper rights. This rule applies to pictures, movies, links, texts, etc. Likewise, mono may not be used to show of offensive or obtrusive content such as pornographic material, pornografic pictures, “hate-sites" or other content, which can be viewed as offensive. mono.net holds the right to assess these matters based on own judgment. Websites containing anything mentioned above will be closed without notice, disregarding whether the given subscription is mono free, mono basic, or any other extension of mono's brand. This includes cases where the subscription is managed by more than one party or is in any ways infiltrated by a third party. The subscriber alone is responsible for all content on his mono site. (this includes information, data, text, software, music, sound, photos, graphics, movies and everything which is labeled as affiliated with these examples). Consideration must be taken to Danish and International law, so as no content is in violation with these. Reload can and will not supervise content on mono websites and cannot be held responsible for the quality and legality of this matter. Furthermore, mono.net reserves the right to remove content such as .zip, .mp3, .jpg, and the likes, in cases where unreasonable burden or stress is applied to Reloads servers. This to prevent that mono is used as external storage for larger quantities of files accessible for free download. mono is intended to be used as a display-area or sales-window for real, physical, and, of course, legally accountable people.

mono.net will, as a rule of thumb; allow free traffic on all mono websites. In any case of severe exploitation of the free traffic associated with mono websites, mono.net reserves the right to discontinue the subscription in question or, as a secondary solution, place a limitation on the bandwidth used for the given subscription. Usage which strains or burdens mono.net’s servers or causes an disproportionately large amount of traffic serve as examples for misuse of an account. mono.net reserves the right to limit or circumscribe the access to a subscribers mono website, should it be found a necessary means to sustain normal operations or prevent security breaches.

It is forbidden to send large number of emails via mono.net 's email system. It is also prohibited to send spam (junk) mail.

In case of violation about illegal content and spam mails reserves mono.net right to inform the relevant authorities and to provide log information, etc. to them. mono.net also reserves the right to charge for time spent in connection with such information and disclosure of log information to authorities.
